    The Thua Thien Hue Provincial Department of Education and Training was established and its functions, duties and powers determined under Decision No. 26/QD-UNND dated July 12th 1989, and its functions, duties, powers and organizational structure further provided for under Decision No. 08/2016/QD-UBND, dated January 21st 2016.

    POSITION AND FUNCTION

     

    Article 1. Position and function

     

    1.  The Department of Education and Training (hereinafter referred to as the Department) is a special agency of the Provincial People's Committee performing the function of advising and assisting the Provincial People's Committee to state manage education and training at the local level, in accordance with the law and as assigned or authorized by the Provincial People's Committee and its Chairman.

     

    2. The Department of Education and Training has legal status, a seal, and separate accounts; in regard to organization, staffing and activities, is subject to the direction and management of the provincial People's Committee; and is under the direction, guidance and professional services inspection of the Ministry of Education and Training.

     

    DUTIES AND POWERS

     

    Article 2. Duties and powers

     

    1. Submit to the Provincial People's Committee:

     

    a) Draft decisions and directives; planning, long-term plans, annual and five-year plans; programs, projects and schemes; measures to implement the tasks of state administrative reform in the field of education and training at the local level;

     

    b) Draft tuition fees and enrollment fees for educational institutions under local management for the provincial people's committees to submit for decisions of people's councils at the same level in accordance with law;

     

    c) Draft documents stipulating the functions, tasks, powers and organizational structure of the Department of Education and Training;

     

    d) Draft guidelines on specific functions, tasks, powers and the organization of the Office of Education and Training under the provisions of paragraph 1, Article 10, Government Decree No.37/2014/ND-CP dated May 5th, 2014, this joint Circular, and other associated legal documents;

     

    đ) Draft documents specifying conditions, criteria, and titles for heads/deputy heads of units of the Department of Education and Training and heads/deputy heads of the Education and Training Division of district people's committees.

     

    2. Submit to the Chairman of the Provincial People's Committee:

     

    a) Draft decisions on the establishment, merger, separation and dissolution of units under the Department;

     

    b) Draft decisions to permit the establishment, merger, separation, dissolution, and change of type of educational establishments (including educational institutions with the investment participation of organizations and foreign individuals) under the Department;

     

    c) Draft decisions and specific directives in the field of education and training under the issuing authority of the Chairman of the Provincial People's Committee.

     

    3. Organize the implementation of legal normative documents, planning, and plans after they are approved; inform, propagandize, guide, disseminate, educate, and enforce and monitor education laws as assigned by management.

     

    4. Implement and be responsible for certification, registration, licensing, diplomas and certificates under the management responsibility of the Department of Education and Training, in accordance with the law and as assigned or authorized by the Provincial People's Committee.

     

    5. Organize the application of experience, scientific achievements, and advanced technologies in education; take stock of local experience and initiatives; manage scientific research and technology in educational institutions under the Department; build information and storage systems to serve the Department's management task.

     

    6. Organize and build progressive, model people, and implement educational competitions, prizes and awards in the local area.

     

    7. Guide and organize testing and inspection of educational institutions under the Department and the Office of Education and Training on the implementation of objectives, programs, content, educational plans, and professional regulations; the implementation of policies for students and conditions that guarantee public education establishments; of enrollments, examinations, and the approval and issuing of diplomas, certificates and the accreditation of education; the task of expanding education, resisting illiteracy, building a learning society at the local level, and other educational activities under the guidance of the Ministry of Education and Training.

     

    8. Guide the creation and synthesis of training plans and the nurture of teachers, civil servants and employees of educational institutions under Departmental jurisdiction; implement after obtaining approval from the competent authority.

     

    9. Guide and organize the mobilization, management, and use of resources to develop local education; check the implementation of self-control and self-responsibility rights of public education establishments under the Department, as regulated by the law.

     

    10. Open professional intermediate level training branches for professional secondary schools under the Department as stipulated by the Ministry of Education and Training.

     

    11. Allow or suspend educational activities for educational institutions under the Department (excluding teachers’ colleges) under regulations of the Ministry of Education and Training.

     

    12. Assist the Provincial People's Committee to  manage the state about the education sector-related activity of enterprises, organizations and individuals at local level; guide and inspect the activities of associations and non-governmental organizations in the field of local education as regulated by the law.

     

    13. Assist the Provincial People's Committee in state managing self-supporting overseas study organizations as regulated by the law; implement international cooperation in the field of education as prescribed by the law and the Provincial People's Committee.

     

    14. Assist the Provincial People's Committee to inspect and supervise observance of the law on education in the task of ensuring the conditions for establishing schools, running educational activities, opening training programs, and publicizing educational quality and conditions guarantee quality of education as prescribed by Ministry of Education and Training.

     

    15. Clearly stipulate the functions, duties and powers of Departmental organizations and the educational institutions.

     

    16. Lead and coordinate with the Department of Planning and Investment to assess conditions and standards for the competent authority to grant investment certificates for educational institutions and foreign individuals; grant and revoke operating licenses; guide, control and inspect the educational activities of educational institutions with the investment participation of foreign organizations and individuals, in accordance with the law.

     

    17. Lead and coordinate with the Department of Finance and the Department of Planning and Investment to specify standards and fees in local education; guide and establish annual education budget estimates for educational institutions under the Department; decide to assign education budget expenditure estimates for educational institutions under the Department after approval by the competent authority; identify and balance state budget spending on education yearly and submit to the competent authority for approval; check the use of state budget and other lawful revenue of educational establishments in the local area.

     

    18. Implement administrative reform, thrift practice, corruption and wastefulness precautions; inspection, solving complaints, denouncements, petition relating to education and deal with violations according to law regulations.

     

    19. Manage, organize the apparatus, appoint personnel, structure of personnel classification scale, work positions, structure of officials according to occupational titles and the number of employees in departmental units; implement salary regulations and priority regulations, training, retraining, rewarding, punishing personnels, officials, and employees breaking law regulations according to the assignment and commission of the Provincial People’s committee.

     

    20. Manage finance, possessions, material facilities assigned according to law regulations and the Provincial People’s committee.

     

    21. Do statistical work, inform, report periodically and annually, report unscheduledly on organization and local educational activities to the Provincial People’s committee and Ministry of Education and Training.

     

    22. Do other missions assigned by the Provincial People’s committee and the chairperson of Provincial People’s committee according to law regulations.

     

    ORGANIZATIONAL STRUCTURE AND PERSONNEL

     

    Article 3. Organizational structure and personnel

     

    1. Departmental Leadership

     

    a) Department of Education and Training has one Director and three deputy directors.

     

    b) The director of Department of Education and Training is responsible to the Provincial People’s committee, the chairperson of Provincial People’s committee and the law for performing functions, duties and authority of Department of Education and Training. Specific duties of the director of Department of Education and Training are:

     

    - Base himself on current law regulations and assignment of the Provincial People’s committee to give out work regulations of the department and guide, inspect the implementation;

     

    - Be responsible to the Provincial People’s committee, the chairperson of Provincial People’s committee and the law for performing functions, duties and authority of Department of Education and Training and work assigned or commissioned by the Provincial People’s committee, the chairperson of Provincial People’s committee. Regarding problems outside jurisdiction or problems within jurisdiction but beyond ability and conditions to solve, the director of Department of Education and Training has to actively cooperate with directors of departments concerned to complete documents in order for the Provincial People’s committee, the chairperson of Provincial People’s committee to consider and make a decision;

     

    - Be responsible for reporting to the Provincial People’s committee, the chairperson of Provincial People’s committee, Ministry, equally ministerial agencies on organization and educational activities of Department of Education and Training; report on departmental work, provide provincial people’s council and people’s committee with documentation when asked; answer petitions of electors, questions of representatives of provincial people’s council about problems relating to education and training in the region; cooperate with other departmental directors, leaders of socio-political organizations and agencies concerned in performing duties of Department of Education and Training.

     

    - Appointment, reappointment, dismissal, rotation, removal, demotion of the leaders and the deputies of departmental education units; admit, deny school boards of departmental education units; admit, deny boards of directors, chairperson of director boards, headmasters, deputy heads of private education units under the management of Provincial People’s committee, including private colleges in the region according to the devolution of Provincial People’s committee.

     

    c) Deputy Directors of Department of Education and Training help the director to do some work, are responsible to the director and the law for duties assigned.

    During the absence of the director, one of the deputy directors is commissioned to manage departmental activities.

     

    d) Nomination, reappointment, dismissal, appointment, rotation, commendation and reward, punishment, the enforcement of resignation, retirement and the implementation of other policies for the board of directors are decided based on the law by the chairman of the people’s committee.

     

    2. The stucture of the organization:

    Testing and assessment division;

    Preschool education division;

    Primary school division;

    Secondary education division;

    Department of professional and continuing training;

     

    b) Organizations run by the department of education and training:

     

    Upper-secondary schools;

     

    Multi-level schools including secondary education;

     

    Boarding schools for ethnic minority students including secondary education;

     

    Technical and vocational orientation center;

     

    Continuing training center;

     

    Fine arts center;

     

    Medical center for students;

     

    Language and computer-based training center;

     

    Schools for the disabled;

     

    Schools and teaching practice places and educational organizations run by the people’s committee of Thua Thien Hue province including vocational schools, independent colleges established by the people’s committee;

     

    Nguyen Tri Phuong lower-secondary school, Hue city;

     

    3. The regular staff

     

    a) The number of officers and workers in the department of education and training is decided basing on the working positions which are suitable for their functions, responsibilities, range of activities. They are one of the members in administrative bodies, provincial public organizations who are ratified by the government.

     

    b) Based on functions, responsibilities, tructure of organization and list of working positions,  the title structure of officers and officials is ratified by the authority. The department of education and training in combination with the home affairs department set out a plan for the number of officers and officials in order to fulfill the assigned duties every year and submit it to the people’s committee for approval.

     

    IMPLEMENTATION

     

    Article 4. Implementation

     

    1) The director of the department of education and training is responsible for organizing to carry out this decision and follows the rules about functions, responsibilities, power and the relationships between the office, inspectorate, specialized divisions and organization run by the department of education and training.

     

    2) The modification or supplement to this decision is suggested by the director of the department of education and training in an agreement with the home affairs department, then it is submitted to the people’s committee for approval.
